Rekonstruksi Teori Maqāṣid Al-Syarī‘ah Pemikiran Muḥammad Ṭāhir Ibn ‘Āsyūr, Aḥmad Al-Raysūnī, Jaseer Auda dan Relevansi Kontemporernya

Abstrak

The complexity of contemporary Islamic legal issues requires an approach that is not merely text-oriented but also focused on the objectives of the law through maqāṣid al-sharī‘ah. This study aims to analyze the concept of maqāṣid al-sharī‘ah developed by Muḥammad Ṭāhir Ibn ‘Āshūr, Aḥmad al-Raysūnī, and Jasser Auda, as well as its relevance to contemporary issues through the framework of uṣūliyyah legal maxims. This library research employs a qualitative approach with descriptive-comparative analysis. The findings reveal that Ibn ‘Āshūr positioned maqāṣid as a systematic discipline, al-Raysūnī developed it into a more operational methodology of ijtihād, while Auda proposed a dynamic and integrative systems approach. The integration of maqāṣid al-sharī‘ah and uṣūliyyah legal maxims is essential for maintaining the objectivity of ijtihād and ensuring that Islamic law remains adaptive and oriented toward public welfare (maṣlaḥah).
